Caregiver LMIA

Canadian families have the option to hire foreign caregivers under the LMIA (Labour Market Impact Assessment) program to provide essential in-home care for children under 18, seniors aged 65 and older, or individuals with certified medical needs. This pathway is designed for situations where no Canadian citizens or permanent residents are available for the role. The program includes two main caregiver categories, each with specific eligibility criteria, and requires a processing fee of $1,000 CAD per position, ensuring families can access the support they need within a regulated framework. 

Categories Under the Caregiver LMIA Program

(1) Caregivers for Children

This category allows families to hire caregivers specifically for children under 18 years of age. Common positions under this category include Nanny roles (NOC 44100).

(2) Caregivers for People with High Medical Needs

Families can apply under this category to provide support for elderly family members (aged 65 and over), individuals with disabilities, or those with chronic or terminal illnesses. Eligible roles in this category include:

(a)  Registered nurse or psychiatric nurse (NOC 31301)

(b)  Licensed practical nurse (NOC 32101)

(c)   Attendant for persons with disabilities, home support worker, live-in caregiver, or personal care attendant (NOC 44101)

Important Points to Note

Living Arrangements: Caregivers have the option to reside outside their employer’s home if preferred.

Fee Exemptions: Employers can qualify for an LMIA application fee exemption under certain conditions:

(i)    Medical Needs: Families seeking a caregiver for someone with certified medical needs are exempt from the $1,000 CAD processing fee.

(ii)   Childcare Needs: Families with an annual gross income of $150,000 or less, who need a caregiver for a child under 13 years old, are also eligible for a fee exemption.

In-Canada Hiring: Caregivers for LMIA-based work permits must be hired from within Canada.
