LMIA based Work Permit
A Labour Market Impact Assessment (LMIA) is a document issued by Employment and Social Development Canada (ESDC) that assesses the impact of hiring a foreign worker on Canada’s labor market. Many Canadian work permits rely on a positive LMIA, showing a genuine need for a foreign worker because no qualified Canadian or permanent resident is available. This LMIA-based permit requires two steps: first, the Canadian employer must apply for the LMIA; second, once a positive LMIA is obtained, the worker can apply for the work permit.
Types of LMIA-Based Work Permits
Skill-Based Work Permits:
Skilled Work Permits: These permits apply to occupations classified as NOC TEER 0, 1, 2, or 3, where candidates generally need 1-3 years of relevant experience or specialized education, plus English or French language proficiency.
Semi-Skilled Work Permits: For NOC TEER 4 and 5 positions, semi-skilled permits require minimal education or training, though language skills remain essential. In agriculture, some specific requirements may be waived. Employers provide benefits like return airfare, affordable housing, and temporary medical insurance.
Wage-Based Work Permits:
High-Wage Workers: When employers offer wages at or above the provincial median, they must submit a transition plan with the LMIA, committing to hire and train Canadians for the role long-term. This includes specific recruitment efforts, training timelines, and goals to decrease reliance on foreign workers.
Low-Wage Workers: Employers must apply under the low-wage stream if the offered wage is below the median. They must meet requirements like covering travel costs, securing affordable housing, providing private health insurance, and registering the worker with workplace safety boards. The government places a cap on low-wage hires per company, with exceptions for agriculture and caregiving.
Employers and foreign workers should consult ESDC or IRCC for up-to-date LMIA program requirements and any available exemptions to ensure compliance and a smooth application process.
